These terms govern the software operated by Young Corporation, including YC FSIM and any other software that links to this page. By using the software, or by receiving text messages sent through it, you agree to these terms.

Who these terms cover

  • Businesses that use the software to run their work, called "the business" here.
  • Staff of those businesses, who sign in to the software to do their jobs.
  • Customers of those businesses who receive text messages sent through the software. The text messaging section is written for them.

If a business has a separate written agreement with Young Corporation, that agreement controls where it conflicts with these terms, except for the text messaging section.

Accounts

An administrator at the business invites each member of its staff. Keep your sign-in details to yourself, and tell your administrator if you think someone else has used your account. The business is responsible for what happens in its accounts.

The business's responsibilities

  • The business keeps the information it enters accurate, and collects its customers' details lawfully, giving notice and getting consent where the law requires.
  • The business uses the software's messaging only to contact its own customers about their service.
  • The business follows the laws that apply to calls, texts and emails, including the Telephone Consumer Protection Act and carrier rules for business texting.

Text messaging

Businesses use this software to text their own customers. This section describes that text messaging program and applies to every business that sends texts through the software and every customer who receives them.

Who sends the messages. Each business texts its customers from its own number, and the business is the sender of every message it sends to its customers. Young Corporation provides the software and does not send marketing messages to anyone.

Consent. A business may text only customers who have agreed to receive its texts. A customer agrees by telling the business in person, by phone or in writing, or by texting the business's number. By turning on text messaging, each business confirms that it has each customer's consent before texting them, and records that consent in the software.

Messages you may receive. You may receive appointment confirmations and reminders, on-the-way updates when a technician is heading to you, links to your estimates and invoices, and two-way conversations with the business about your service.

Frequency and cost. Message frequency varies with your appointments and conversations. Msg & data rates may apply.

Consent is not a condition of purchase. You can buy from the business without agreeing to receive texts.

Opting out and back in. Reply STOP to the number that texted you at any time to opt out. You will get one text confirming that you have opted out, and no further texts after that. Reply START to the same number to opt back in.

Help. Reply HELP to the number that texted you for help, or contact the business directly. You can also email hello@ycorp-app.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

Privacy. The privacy policy explains how mobile information is protected. Mobile information and opt-in data are never sold or shared for marketing.

This section controls. This section controls over anything else in these terms, and over any separate agreement with a business, wherever text messaging is concerned.

Acceptable use

Do not use the software to break the law, to send messages people did not agree to receive, to get into accounts or data that are not yours, or to interfere with the software or other people's use of it.

The business's data

The information a business enters belongs to that business. Young Corporation uses it only to provide the software, as the privacy policy describes. The software itself, and everything Young Corporation builds into it, belongs to Young Corporation.

Changes to the software

We improve the software over time, which can mean adding, changing or removing features. We aim to keep it available, but we do not promise it will run without interruption or error.

Disclaimers

The software is provided as it is and as it is available. To the extent the law allows, Young Corporation disclaims all warranties not stated in these terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, Young Corporation is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from the software.

Ending use

A business can stop using the software at any time. We may suspend or end access for anyone who breaks these terms.

If the operator changes

Young Corporation may transfer the software, these terms and the business's agreement with it to a successor that takes over the software, for example in a reorganization, merger or sale. The successor becomes the operator under these terms. We will update this page to name the new operator.

Changes to these terms

When these terms change, we update this page and its effective date. If a change matters to how a business uses the software, we tell the business before it takes effect.
